Task Order Selection Process

Fair Opportunity to Be Considered. Task Orders will normally be competed by submitting the Task Proposal Request (TPR) to all Contractors within TASC. An exception can be made for small businesses.  Other exceptions (Section H.7.(a) page 32 of the contract) include urgency, unique or predominant capability, or follow-ons - but the justification must be compelling and fully explained in writing. Exceptions must be approved by the Contracting Officer. Where follow-on work is anticipated, this should be stated in the initial TPR to allow Contractors to propose on the basis of that information. In those cases, subsequent work does not have to be competed.

In cases where follow-on work is involved but where it still makes sense to compete and give other firms an opportunity to propose, the invitation to propose will contain language advising bidders that this is follow-on work with an incumbent Contractor.

While the competition issue must be addressed for each procurement under these contracts, be aware that under "Fair Opportunity" this can be done in several ways. Fair Opportunity means that all competitors have to be given consideration. This does not always require a proposal from each contractor. For example, if there is information available concerning the capability or capacity of one or more of the contractors which will create a sole source situation or a short-list, this method can be used to reduce the competitive range providing that the information can be documented. The key here is justification and documentation. One thing to keep in mind is that it costs the contractors considerable time and money to respond to TPRs where they do not have a chance of winning. If you are not sure whether your approach constitutes Fair Opportunity, consult with your Contracting Officer for guidance.

Selection Committee: The CTO will form a selection committee which will review the technical proposals and issue a "Selection Statement" to the Contracting Officer.

Selection Statement: The selection statement is essential to document that "Fair Opportunity to be Considered" practices have been followed. The statement should at a minimum describe the firms that submitted proposals, weighted evaluation criteria used, scores given each proposal, and why the winner was selected.

All technical evaluation committee members will prepare individual scores and brief explanations for the proposals they have reviewed. This information will become an attachment to the selection statement. This selection statement is an important document for the Contract CTO files in case of complaints from a Contractor which has not received many task orders. (Attachment C provides a sample format.)

Modifications: The selection statement for any modification which provides for an expansion of work and/or extension of the Task Order period must address Contractor performance to date and whether tangible results and benchmarks have been met.

Debriefings: Debriefings, when requested, will be provided promptly by the evaluation committee chairperson and CO, if needed, after the Task Order has been awarded. Debriefings should be limited to disclosing the number of firms solicited, evaluation criteria and strengths and weaknesses of the offeror's proposal based on such criteria, competitiveness of proposal, and any suggestions for future proposals.
